Terms of Service

The agreement between you and Pulsewise Pty Ltd governing your use of the Pulsewise service. Subject to Australian law and the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

1. The service

Pulsewise monitors the customer-acquisition channels of medical clinics — phone numbers, contact forms, fax lines, email infrastructure, Google Business Profile, online reviews, SSL certificates, listings consistency, and similar — and surfaces issues that may be costing the clinic patient bookings.

The service is delivered in one of two ways:

These terms govern both. Where a clinic uses the service through an MSP, the MSP is the primary account holder and is responsible for paying Pulsewise.

To use the service you'll create an account. You agree to:

We may suspend or terminate accounts that violate this section without prior notice when necessary to protect other users or comply with law.

4. Fees and billing

Fees are payable in Australian dollars, exclusive of GST unless stated otherwise. The current price list is available on our website.

Direct customers are billed monthly in advance via Stripe.

Reseller MSPs are billed monthly in arrears for active clinic seats at the wholesale rate locked at each seat's activation date. The MSP is responsible for billing their clinic customers; Pulsewise is not party to that arrangement.

Late payments may attract a reasonable late fee. We may suspend service for non-payment after 14 days' notice.

5. Cancellation and termination

You may cancel your account at any time. On cancellation:

We may terminate your account if you materially breach these terms, with reasonable notice where practical.

6. Availability and disclaimers

We aim for high availability but don't promise an uptime SLA in these terms (we may offer one in a separate addendum for some plans).

Pulsewise monitors infrastructure — it's a tool to surface potential issues, not a guarantee. Specifically:

You're responsible for verifying any finding before acting on it, especially before taking actions that affect customers (changing phone numbers, updating business listings, etc.).

7. Liability

To the maximum extent permitted by law, our aggregate liability to you under these terms is limited to the fees you've paid Pulsewise in the 12 months preceding the event giving rise to the claim.

We're not liable for indirect, consequential, special, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, even if we've been advised of the possibility.

This section does not exclude or limit liability that cannot be excluded under Australian law — see "Australian Consumer Law" below.

8. Australian Consumer Law

If you're a consumer under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)), our service comes with guarantees that cannot be excluded — including guarantees that the service will be provided with due care and skill and will be reasonably fit for any disclosed purpose.

If we breach a consumer guarantee, your remedies are as set out in the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies those rights.

9. Changes to these terms

We may update these terms. For material changes (changes that materially reduce your rights), we'll notify you by email at least 30 days before the change takes effect. If you don't agree, you can cancel before the change takes effect.

For non-material changes (formatting, contact details, clarifications), the updated terms take effect when posted.

10. Disputes and governing law

If you have a dispute with us, please contact us first at contact@pulsewise.com.au so we can try to resolve it.

These terms are governed by the laws of Victoria, Australia, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Victoria, Australia.
